Dear Gov. Murphy: Have some ‘pride’ and reappoint Judge Mirtha Ospina
For the sake of truth and justice, Gov. Phil Murphy should disregard Democratic Party bosses and reappoint Hudson County Superior Court Judge Mirtha Ospina.
It’s safe to say I’m not the biggest fan of U.S. Senator Robert Menendez (D), but I wholeheartedly agree with the following quote about Hudson County Superior Court Judge Mirtha Ospina – “yes intellect, yes judicial temperament and yes the ability to judge fairly within the constraints of the law and precedent.”
That comment was made in 2012 at a swearing-in ceremony after Ospina was successfully nominated by Gov. Chris Christie (R). Yet, it wasn’t until 2018, during the The State vs Joseph Ascolese, Kelly Chesler, and Michael O’Neill, that regular people like myself had the opportunity to see how true the senator’s words were.
According to sources, because Ospina demonstrated the characteristics Menendez stated during the aforementioned trial, which ended the malicious prosecution of a female whistleblower alleging sexual harassment, the judge will not be reappointed by Gov. Phil Murphy (D).
Without delving into the details at this time, it’s clear that Ospina has fallen victim to the “good ol’ boys club” that runs Hudson County and wants her off the bench. The apparent hypocrisy of Murphy – who markets himself as a champion of justice, diversity, women’s rights, and LGBT equality – would be laughable if the integrity of the justice system wasn’t at stake.
That’s because Ospina is both a Latina and lesbian, as well as a Republican, but most importantly – she’s not beholden to the Hudson County Democratic Organization (HCDO) machine. Her greatness transcends identity politics and the value of her independence is priceless.
Supreme Court Justice Sonia Sotomayor faced controversy for once saying “I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.”
Without a doubt, the richness of Ospina’s experiences – from her humble immigrant roots to trying 60 cases over 14 years as an assistant prosecutor at the Middlesex County Prosecutor’s Office – is a treasure for the people of Hudson County that must be protected.
That’s why I’m publicly asking Governor Murphy to reappoint Mirtha Ospina as a Hudson County Superior Court judge – which needs to be done by June 27, 2019.
