Dear Gov. Murphy: Have some ‘pride’ and reappoint Judge Mirtha Ospina

For the sake of truth and justice, Gov. Phil Murphy should disregard Democratic Party bosses and reappoint Hudson County Superior Court Judge Mirtha Ospina.

It’s safe to say I’m not the biggest fan of U.S. Senator Robert Menendez (D), but I wholeheartedly agree with the following quote about Hudson County Superior Court Judge Mirtha Ospina – “yes intellect, yes judicial temperament and yes the ability to judge fairly within the constraints of the law and precedent.”

That comment was made in 2012 at a swearing-in ceremony after Ospina was successfully nominated by Gov. Chris Christie (R). Yet, it wasn’t until 2018, during the The State vs Joseph Ascolese, Kelly Chesler, and Michael O’Neill, that regular people like myself had the opportunity to see how true the senator’s words were.

According to sources, because Ospina demonstrated the characteristics Menendez stated during the aforementioned trial, which ended the malicious prosecution of a female whistleblower alleging sexual harassment, the judge will not be reappointed by Gov. Phil Murphy (D).

Without delving into the details at this time, it’s clear that Ospina has fallen victim to the “good ol’ boys club” that runs Hudson County and wants her off the bench. The apparent hypocrisy of Murphy – who markets himself as a champion of justice, diversity, women’s rights, and LGBT equality – would be laughable if the integrity of the justice system wasn’t at stake.

That’s because Ospina is both a Latina and lesbian, as well as a Republican, but most importantly – she’s not beholden to the Hudson County Democratic Organization (HCDO) machine. Her greatness transcends identity politics and the value of her independence is priceless.

Supreme Court Justice Sonia Sotomayor faced controversy for once saying “I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.”

Without a doubt, the richness of Ospina’s experiences – from her humble immigrant roots to trying 60 cases over 14 years as an assistant prosecutor at the Middlesex County Prosecutor’s Office – is a treasure for the people of Hudson County that must be protected.

That’s why I’m publicly asking Governor Murphy to reappoint Mirtha Ospina as a Hudson County Superior Court judge – which needs to be done by June 27, 2019.

  • To have a Superior Court judge have her position jeopardized due to Politics proves how badly the “Swamp” is, even in NJ state politics! Her LGBT affiliations and being a Minority woman also proves the lack of equal opportunities the NJ senate says they believe in!

  • I was on a jury with her as a judge. I think she is a very nice person, and have no problem with her as a Latina or a LGBT. Very polite, would love to have her as personal or professional council. She would make a great corporate lawyer. Judge Ospina would do very well in the financial world where I worked 20 plus years ago as a young man.

    However, I do not want ANYONE on the bench in Jersey City, whether county, state, or federal, that was not born and raised here in Jersey City.

    The aforementioned trial involved a murder. Bottom line, a person not from here verbally assaulted a person of Color, and an older defenseless relative, three blocks from my house. What resulted is exactly what someone who is from here understands is going to happen when you go there with a person of Color.

    The now deceased violator of OUR community norms was NOT white, but was from a country in the Middle East, who thought he was culturally and socially superior to a young man of Color, who, in turn, took very extreme action proving the now deceased wrong. The now deceased got EXACTLY what he deserved.

    Many of the people on the jury, who were not from here did not get it. I am from here, I get it. The vote was 11-1 for conviction.

    I do not want people in office, on the bench or as cops in Jersey City who are NOT born and raised here. The rest of you have no right to judge us. We are a special kind of fucked up. Only people from here are fit to judge us.

    Judge Ospina would do better in private practice, and when the young man mentioned above gets out of state prison, I think he should go to law school and become a local judge. He is from here, and he understands how to respond to egregious violations of OUR community norms.

  • thanks to people like you we still have a free press who can shed light on the reality of judicial appointments. our public needs judges like Judge Ospina and we need to support an independent judiciary or the entire justice system breaks down. Mr. Murphy you need to do what you promised your state and not be beholden to your donors.

  • The only Colombian-American female Superior Court Judge and she might not be reappointed by NJ Governor Phil Murphy (D)?  Look at Judge Mirtha Ospina’s successes and reappoint. Put party affiliations aside and look to what’s best for NJ’s success. Reappoint Judge Ospina!

  • I whole heartedly agreed. It should not matter what party she is. All the should matter is that she upholds the LAW!
